Terms of Service

These Terms of Service govern your access to and use of mint2belifestyle.com, including purchases and other interactions with Mint2Be Lifestyle.

Mint2Be Lifestyle is operated by Mint 2 Be Home Solutions LLC, a California limited liability company. In these Terms, “Mint2Be Lifestyle,” “we,” “us,” and “our” refer to Mint 2 Be Home Solutions LLC and the Mint2Be Lifestyle store. “Website” and “Services” refer to mint2belifestyle.com and the products, content, features, communications, and services offered through it. “You” and “your” refer to the person accessing or using the Services.

By visiting the Website, creating an account, submitting an order, or otherwise using the Services, you agree to these Terms. If you do not agree, do not use the Services.

1. Eligibility

You must be at least 18 years old or the age of majority where you live to place an order or create a customer account. A parent or legal guardian may use the Services to purchase products for a minor.

By using the Services, you represent that you have the legal capacity to enter into these Terms. If you use the Services on behalf of a business or organization, you represent that you have authority to bind that entity to these Terms.

2. Our Store and Shopify

Our online store is hosted by Shopify. Shopify provides the commerce platform that allows us to display and sell products, process checkout, support customer accounts, and manage orders.

Any contract for the purchase of a Mint2Be Lifestyle product is directly between you and Mint 2 Be Home Solutions LLC. Shopify and other service providers are not the seller of our products and are not responsible for our products, fulfillment, returns, customer service, or representations.

Your use of optional third-party services such as Shop Pay, PayPal, Apple Pay, or Google Pay may also be governed by the terms and privacy notices of those providers.

3. Products and Product Information

We work to describe and display our products accurately. However:

• Colors may appear differently depending on your screen, lighting, device, and display settings.
• Garment measurements, fit, fabric composition, texture, and color may vary slightly by size, production batch, or blank-product supplier.
• Placement, scale, saturation, and appearance of printed or heat-applied artwork may vary slightly because of normal production tolerances.
• Handmade, small-batch, personalized, or made-to-order products may contain minor differences that are not defects.
• Product photographs may include styling items, props, or accessories that are not included unless the product description says otherwise.

Please review the product description, size chart, care instructions, price, availability, production information, and applicable store policies before ordering.

We may correct typographical errors, inaccurate descriptions, pricing mistakes, inventory errors, or omissions at any time. If a material error affects an order you already placed, we may contact you for instructions or cancel the affected item and issue an appropriate refund.

4. Availability and Purchase Limits

Products may be offered in limited quantities, made to order, released seasonally, or discontinued without notice. Placing an item in a cart does not reserve it.

We may limit quantities, refuse an order, or cancel an order when reasonably necessary, including because of:

• Product or material unavailability;
• Pricing, description, or inventory errors;
• Suspected fraud, unauthorized payment, resale abuse, or other unlawful activity;
• A request we cannot safely or lawfully fulfill;
• Violation of these Terms or another posted policy; or
• Shipping restrictions.

If we cancel a paid order, we will refund the amount charged for the canceled portion using the original payment method, subject to the payment provider’s processing time.

5. Orders and Acceptance

Your order is an offer to purchase the products listed in the order. An automated order confirmation acknowledges that we received the order; it does not necessarily mean that we have accepted or begun producing it.

We accept an order when we begin fulfillment, send a shipment confirmation, or otherwise expressly confirm acceptance. We may contact you if information is incomplete, inconsistent, or requires clarification.

You are responsible for reviewing your order before submitting it and for providing accurate billing, shipping, contact, size, color, quantity, and personalization information. Contact us promptly if you notice an error. We cannot guarantee that an order can be changed or canceled after production or fulfillment begins.

6. Personalized and Customer-Directed Orders

If we offer personalization or accept customer-supplied text, images, logos, names, or other material, you represent and warrant that:

• The information and material you provide are accurate;
• You own the material or have all permissions necessary for us to use it;
• Our production of the requested item will not violate another person’s copyright, trademark, privacy, publicity, contractual, or other rights;
• The request is not unlawful, misleading, defamatory, threatening, hateful, obscene, or otherwise harmful; and
• The request does not falsely suggest sponsorship, affiliation, endorsement, or authorization.

You grant Mint2Be Lifestyle a limited, nonexclusive license to use customer-supplied material only as reasonably necessary to review, produce, fulfill, document, and support your order.

We may refuse or cancel any personalization request that we believe may violate law, third-party rights, our standards, or these Terms. Customer-supplied spelling, dates, names, sizing, colors, and other selections are your responsibility. Eligibility for changes, cancellations, returns, or refunds is governed by the Refund Policy and any terms shown on the relevant product page.

7. Prices, Payments, and Taxes

Prices are shown in U.S. dollars unless stated otherwise. Prices, product availability, discounts, and promotions may change without notice before an order is submitted.

You agree to pay the price, shipping charges, taxes, and other amounts shown during checkout. Applicable sales tax is calculated based on the information available at checkout and legal requirements.

Payments may be processed through Shopify Payments, Shop Pay, PayPal, Apple Pay, Google Pay, or other payment methods displayed at checkout. You represent that you are authorized to use the selected payment method and authorize the applicable provider to charge the order total.

We do not directly store complete payment-card numbers. Payment authorization, fraud review, settlement, and refund timing may be subject to the payment provider’s terms.

8. Promotions and Discount Codes

Promotions and discount codes:

• Apply only during the stated promotional period;
• May be subject to product, quantity, customer, or order-value restrictions;
• Cannot be combined unless expressly allowed;
• Have no cash value;
• May not be reproduced, resold, or used fraudulently; and
• May be changed, suspended, or canceled when reasonably necessary because of error, abuse, fraud, or legal requirements.

Additional terms displayed with a promotion are incorporated into these Terms. If promotional terms conflict with these general Terms, the more specific promotional terms control for that promotion.

9. Shipping and Delivery

Mint2Be Lifestyle ships only within the United States at launch.

Production, processing, and delivery dates are estimates unless we expressly guarantee a date in writing. Delays may occur because of product availability, made-to-order production, carrier operations, weather, holidays, incorrect addresses, security review, or events outside our reasonable control.

You are responsible for providing a complete and accurate delivery address. Additional costs caused by an incorrect, incomplete, refused, or undeliverable address may be your responsibility to the extent permitted by law.

Shipping methods, estimated fulfillment timelines, delivery procedures, lost- or damaged-package reporting, and related terms are described in our Shipping Policy. Title and risk of loss are determined by applicable law and the shipping terms presented with your order. Nothing in these Terms limits rights that cannot lawfully be waived.

10. Returns, Exchanges, Refunds, and Cancellations

Returns, exchanges, refunds, damaged or defective items, incorrect orders, and cancellations are governed by our Refund Policy and any product-specific terms shown before purchase.

Some made-to-order, personalized, clearance, final-sale, hygiene-sensitive, or otherwise identified products may have restricted return eligibility where permitted by law. Any restriction will be disclosed in the Refund Policy or on the applicable product page.

Nothing in these Terms or the Refund Policy limits rights or remedies that cannot lawfully be excluded.

11. Customer Accounts

Customer accounts are optional at launch. If you create or use an account, you agree to:

• Provide accurate and current information;
• Protect your login method and account access;
• Restrict unauthorized use of your device or account;
• Accept responsibility for activity performed through your account; and
• Notify us promptly if you suspect unauthorized access.

We may suspend or terminate an account when reasonably necessary to protect the Services, investigate misuse, comply with law, or enforce these Terms. Account termination does not eliminate payment, return, intellectual-property, or other obligations that arose before termination.

12. Acceptable Use

You may use the Services only for lawful personal or business purchasing purposes. You may not:

• Violate applicable law or another person’s rights;
• Use the Services for fraud, deception, harassment, threats, abuse, or unlawful discrimination;
• Submit false, misleading, or unauthorized information;
• Attempt unauthorized access to an account, system, checkout, or network;
• Introduce malware, malicious code, or other harmful technology;
• Interfere with the operation, security, or availability of the Services;
• Scrape, crawl, harvest, copy, or monitor the Services through automated means except as permitted by law and our written authorization;
• Circumvent purchase limits, security controls, access restrictions, or checkout procedures;
• Use the Services to infringe copyright, trademark, privacy, publicity, or other rights;
• Reproduce, resell, or commercially exploit Website content without written permission; or
• Use our names, artwork, designs, photographs, product descriptions, or brand elements to create confusingly similar or counterfeit goods.

We may restrict access, cancel orders, preserve evidence, or report activity when reasonably necessary to address suspected violations.

13. Intellectual Property

The Website and its contents—including original artwork, apparel graphics, product designs, logos, names, photographs, illustrations, text, product descriptions, layout, graphics, downloads, and other materials—are owned by or licensed to Mint 2 Be Home Solutions LLC and are protected by applicable intellectual-property laws.

Mint2Be Lifestyle may feature distinct family brand worlds and collections, including Oaklight & Origin, The Faithful Oak, tater top, and From Bed to Bar. Displaying a name, design, product, or collection does not grant any license or ownership right.

We grant you a limited, revocable, nonexclusive, nontransferable right to access and use the Website for lawful shopping and personal informational purposes. Except as allowed by law or with our prior written permission, you may not reproduce, modify, distribute, sell, license, create derivative works from, or commercially exploit our content.

Purchasing a physical product does not transfer the copyright, trademark, design rights, production files, or other intellectual-property rights associated with the product.

14. Copyright and Intellectual-Property Concerns

We respect intellectual-property rights. If you believe content on the Website infringes a right you own, email privacy@mint2belifestyle.com with:

• Your name and contact information;
• Identification of the protected work or right;
• Identification and location of the allegedly infringing material;
• A statement explaining your good-faith belief that the use is unauthorized;
• A statement that the information provided is accurate and that you are authorized to act; and
• Your physical or electronic signature.

We may request additional information before acting. Knowingly submitting a materially false infringement claim may create legal liability.

15. Third-Party Services and Links

The Services may contain links to or integrations with Shopify, payment providers, shipping carriers, social-media platforms, From Bed to Bar, and other third-party websites or services.

We do not control and are not responsible for a third party’s availability, content, security, products, terms, privacy practices, or conduct. A link does not necessarily mean that Mint2Be Lifestyle endorses the third party. Your use of third-party services is at your discretion and may be governed by separate terms.

16. Informational Content

Any lifestyle, apparel-care, creative, gardening, food, household, educational, or other informational content made available through the Services is provided for general information. It is not legal, medical, financial, safety, or other professional advice.

You remain responsible for evaluating information, following product labels and manufacturer instructions, considering allergies and individual circumstances, and seeking qualified professional advice when appropriate.

17. Disclaimer of Warranties

To the fullest extent permitted by law, the Website, Services, and informational content are provided on an “as available” basis. Except for express warranties stated in writing or rights that cannot lawfully be excluded, we disclaim implied warranties, including warranties of merchantability, fitness for a particular purpose, title, and noninfringement.

We do not warrant that the Website will always be uninterrupted, secure, error-free, or available; that all descriptions or images will be perfectly accurate; or that every product or feature will remain available.

Some jurisdictions do not permit certain warranty exclusions. In those jurisdictions, the exclusions apply only to the extent allowed by law.

18. Limitation of Liability

To the fullest extent permitted by law, Mint 2 Be Home Solutions LLC and its owners, employees, agents, contractors, and affiliates will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages; loss of profits, revenue, data, goodwill, or opportunity; or damages arising from unauthorized access, service interruptions, third-party services, shipping delays, or misuse of the Services.

To the fullest extent permitted by law, our aggregate liability arising from a particular product or order will not exceed the amount you paid to Mint2Be Lifestyle for the product or order giving rise to the claim.

These limitations do not apply to liability that cannot legally be limited or excluded, including any nonwaivable consumer rights.

19. Indemnification

To the fullest extent permitted by law, you agree to defend, indemnify, and hold harmless Mint 2 Be Home Solutions LLC and its owners, employees, agents, contractors, and affiliates from third-party claims, losses, liabilities, damages, judgments, and reasonable costs arising from:

• Your material violation of these Terms;
• Your unlawful or unauthorized use of the Services;
• Customer-supplied material or personalization instructions that infringe another person’s rights; or
• Your fraud, willful misconduct, or violation of law.

This section does not require indemnification for conduct attributable to Mint2Be Lifestyle where prohibited by law.

20. Suspension and Termination

We may suspend or terminate access to the Services, refuse service, or cancel an unfulfilled order when reasonably necessary because of suspected fraud, security risk, unlawful conduct, abuse, violation of these Terms, or operational necessity.

You may stop using the Services at any time. Provisions that by their nature should continue—including payment obligations, intellectual-property protections, disclaimers, limitations of liability, indemnification, and dispute provisions—survive termination.

21. Governing Law and Disputes

These Terms and disputes arising from them are governed by the laws of the State of California, without regard to conflict-of-law principles, except where federal law applies.

Before filing a lawsuit, you and Mint2Be Lifestyle agree to make a good-faith effort to resolve the dispute informally. Send a written description of the dispute and requested resolution to privacy@mint2belifestyle.com. We will use reasonable efforts to respond.

If informal resolution is unsuccessful, and unless applicable consumer law permits or requires another location, disputes must be brought in the state or federal courts with jurisdiction in Sacramento County, California. You and Mint2Be Lifestyle consent to the personal jurisdiction of those courts.

These Terms do not require binding arbitration and do not waive any nonwaivable right to bring an eligible matter in small-claims court.

22. Changes to the Services or Terms

We may modify, suspend, or discontinue all or part of the Services, subject to obligations associated with orders already accepted and applicable law.

We may update these Terms to reflect changes in our products, Services, business practices, or legal obligations. The “Last Updated” date identifies the current version. Changes apply prospectively when posted unless a later effective date is stated. When required, we will provide additional notice before a material change takes effect.

Your continued use of the Services after updated Terms take effect constitutes acceptance of the revised Terms.

23. General Provisions

These Terms, together with the Privacy Policy, Refund Policy, Shipping Policy, product-page terms, and any additional terms presented during checkout, form the agreement governing your use of the Services and purchases.

If a specific product, promotion, Refund Policy, or Shipping Policy conflicts with these general Terms, the more specific terms control for that subject, to the extent permitted by law.

If any provision is found unenforceable, it will be limited or removed only to the minimum extent necessary, and the remaining provisions will remain in effect. A failure to enforce a provision is not a waiver. You may not assign your rights or obligations under these Terms without our written consent. We may assign these Terms in connection with a reorganization, financing, merger, acquisition, or sale of all or part of the business.

Headings are for convenience only. These Terms do not create a partnership, joint venture, employment relationship, agency, or franchise between you and Mint2Be Lifestyle.
